With apologies for the short notice, I write to ask you to oppose Blue Hawaiian Helicopter's petition to the Federal Aviation Administration for an exemption from current essential air safety regulations to allow for much lower flights (under current 1,500 feet) over O’ahu (and other islands).
This short deadline is because both Blue Hawaiian Helicopters and the FAA failed to do any more than the minimal notice required to advise the public (virtually nothing) of the petition (filed August 18th) and the deadline for public comment is tomorrow, Monday, September 8th at 5:59PM Hawai‘i time.

For background, earlier this year Blue Hawaiian Helicopters (which is headquartered in Colorado) requested an exemption from the regulation that sets a minimun flight altitude of 1,500 feet for air tours in Hawai‘i so it can fly lower in certain areas of Kaua‘i. I joined many Hawai‘i residents in opposing that request on both safety and community disruption grounds my letter in opposition here.
As you know, I have worked for six years now in Congress to address the unacceptable safety risks and noise and visual disruptions caused by the tour helicopter and small aircraft industry. Despite widespread community objections, this industry continues its efforts to expand operations into every part of Hawai‘i, increasingly ignoring even the current 1,500 minimum altitude requirement, overflying sensitive areas such as Punchbowl and Pearl Harbor, flying thirty to fifty-plus times a day over many communities, flying before 8am and after 5 pm, and generally disrespecting our communities.
Blue Hawaiian Helicopters latest petition is just one more effort to fly wherever, whenever and however the industry wants, with virtually no check by the FAA. It should be obvious that it is far more dangerous, not safer, to fly lower over terrain especially mountains and ridges; this is just about the helicopter companies not wanting to fly higher to start with. Blue Hawaiian Helicopters also argues it only intends to fly lower than 1,500 feet over areas that are not existing neighborhoods, but that ignores the fact that we all should be able to enjoy our parks and beaches and other non-housing areas without low-flying helicopter and small aircraft disruption.
